The Supreme Court held that a company that had been removed from the company register, could have been represented by a person who was eligible to represent the company on the grounds of chapter 20, section 15 of the Limited Liability Companies Act.

The Supreme Court held in its judgement 2007:39 that an arbitration clause between the insurer and the insured was also valid towards a third party who suffered damages. Thus, the average adjuster was not authorised in the case between the injured party and the insurer.
